RULES AND PROCEDURES

AGREEMENT TO ABIDE BY THE RULES – By entering The Board of Visitors 2020 Virtual Fashion Show Raffle (the “raffle”), participants confirm that they are at least eighteen (18) years of age, are present in Arizona at the time of ticket purchase, and have read, understand, and agree to abide by these rules and procedures (the “rules”).

QUESTIONS – Questions concerning the raffle or the rules should be directed to the Raffle Administrator at 602-909-2504 (the “Raffle Administrator”).

Inquiries regarding the raffle must be made to the Raffle Administrator prior to the purchase of ticket(s).

ELIGIBILITY FOR THE RAFFLE – Only natural persons can enter the raffle or win a prize. Raffle tickets purchasers, and anyone to whom a raffle ticket purchaser transfers a ticket, must be at least eighteen(18) years old at the time of purchase, and no-one under the age of eighteen (18) at the time the ticket was purchased may win a prize or a portion of a prize in the raffle. Ticket purchasers must be physically present in the State of Arizona at the time tickets are purchased, although it is not required that they be Arizona residents. Any ticket purchased from outside Arizona is void and not eligible for any drawing. In the event of an invalid check or credit card payment, all tickets issued as a result of the invalid payment are void and not eligible for any drawing.

PRIZES – Prizes for the DRAWING are:

  • Louis Vuitton Twist Bag (value $3,850)
  • Schmitt Jewelers 3.04 Carat Cushion-Cut Pink Tourmaline and Diamond Pendant and Necklace in 18-Karat White Gold (value $2,600)
  • The Spa at Camelback Inn Robe and Gift Certificate (value $1,125)
  • White House Design Studio Gift Certificate (value $1,000)

Prizes may not be exactly as listed above, shown in printed materials, advertised, or displayed on the internet. Similar or like kind prizes may be substituted at the sole discretion of the Raffle Administrator. Prizes must be accepted as awarded.

TICKETS – Tickets for the DRAWING are sold individually and or in packages of five (5) or ten (10). Individual tickets cost $100 each. A package of five (5) tickets is $300. A package of ten (10) tickets is $500. Each raffle ticket, whether purchased individually or as part of a package of five (5) or ten (10) may have only a single name and address listed, and the ticket receipt can only be sent to the listed name and address. Raffle tickets and raffle ticket stubs will not be sent to listed participants through the mail.

For purchases made online, tickets will be completed with the information provided by listed participants and these completed tickets will be placed into the drawing. Notifications will only be sent to the listed name and address. Listed participants are required to notify the Raffle Administrator if they have a new mailing address. Prizes can only be claimed by, and are issued, distributed and paid only to, the participant listed on the winning raffle ticket. In the event that the listed participant legally shares in the purchase of a ticket with a third person, or legally transfers all or a portion of their interest in a ticket to a third person, it is the responsibility of the listed participant to share any notification and prize with that third person and neither The Board of Visitors nor the Raffle Administrator are responsible for resolving disputes between listed participants and third persons.

Tickets can be purchased via the internet or at designated locations. Those purchasing tickets over the internet will be able to print their ticket receipt. Ticket receipts will also be e-mailed to internet purchasers. A hard copy of the ticket receipt is not required to claim a prize.

DRAWINGS – The drawing will occur during The Board of Visitors Virtual Fashion Show on November 29, 2020.

NOTIFICATION OF WINNERS – All winners will be notified by phone and/or email and will be given instructions on how to collect their prize.

CLAIMING PRIZES – Potential winners are required to claim their prize within six (6) months of the drawing. In order to claim and receive their prize, potential winners may, at the sole discretion of the Raffle Administrator, be required to provide identification, to provide proof of eligibility, to contact the Raffle Administrator, to appear in person, and/or to complete paperwork. All potential winners may be required to complete, execute and return an IRS Form 5754, an affidavit of eligibility, a liability release, a prize release form, a selection of prize form and a publicity release in order to claim their prize(s). If a potential winner does not claim a prize within the required period, does not execute and return required documents within the specified time period, is not in compliance with these rules, or is otherwise found to be ineligible, then, at the Raffle Administrator’s sole discretion, the potential winner will be disqualified and the prize(s) will be forfeited and donated back to The Board of Visitors.

TAXES – The purchase price of raffle tickets does not qualify as a deductible charitable contribution. Each prize winner is responsible for any and all federal, state and local income or excise taxes, fees, assessments, and like charges associated with their prize and for paying any such amounts. Raffle winnings are taxable income and must be reported as such on income tax returns. Raffle winners may be asked by the Raffle Administrator to complete documentation as may be required by the Raffle Administrator. At the time of this printing, federal law requires that the corresponding federal income tax withholding for prizes valued at more than $5,000 must be collected from winners upon prize distribution. Thus, prizes valued at more than $5,000 will be distributed only after an amount equal to 28% of the value of the prize is withheld or collected for the corresponding federal tax. Federal and state tax withholding laws are subject to change without notice. The withholding laws in effect at the time prizes are distributed will be followed.

STATEMENTS – Statements made regarding the raffle are based on information available to the Raffle Administrator at the time these rules were first printed.

LANGUAGE – The raffle is conducted in English.

LAWS AND REGULATIONS – All applicable federal, state and local laws and regulations are incorporated into these rules. The raffle is conducted pursuant to A.R.S. § 13-3302.

CONDITIONS/USE RIGHTS – By accepting any prize, each winner consents to the use of their name, voice, and likeness, and all accompanying personally identifiable information the winner submits, via all forms of media now known or hereafter devised worldwide, in perpetuity, without notice, attribution or compensation (other than the prize(s) won) to the winner, his/her successors or assigns, or any other entity, except where prohibited by law.

PRIVACY – The Board of Visitors respects the privacy of their raffle supporters; it does not sell, rent or trade our supporter lists. The information collected is used solely to process raffle ticket purchases. If at any time you wish to be excluded from such contacts, please contact the Raffle Administrator.

WAIVER/LIMITATIONS OF LIABILITY – By choosing to participate in the raffle, ticket purchasers, ticket holders, and prize winners release The Board of Visitors, the Raffle Administrator, and each of their respective parent companies, affiliates, partners, subsidiaries, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising and promotion agencies (the “released parties”), from any and all liability whatsoever, and waive any and all causes of action, for any claims, costs, injuries, losses and damages of any kind arising out of or in connection with the raffle or acceptance, possession, or use of any prize (including, without limitation, attorneys’ fees, claims, costs, personal injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. No released party shall be responsible if any prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.

MISCELLANEOUS – The decisions of the Raffle Administrator are final with respect to all aspects of this raffle. The raffle and these rules will be governed, construed and interpreted under the laws of the State of Arizona, without regard to choice of law principles. In the event that the operation, security, or administration of the raffle is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problems, or any condition caused by events beyond the reasonable control of the Raffle Administrator that may cause the raffle to be disrupted or corrupted, the Raffle Administrator may, in its sole discretion, either: (a) suspend the raffle to address the impairment and then resume the raffle in a manner that best conforms to the spirit of these rules; or (b) draw winners from only the non-suspect, eligible entries received up to the time of the impairment. The Raffle Administrator reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process, to be tampering with the operation of the raffle, to be acting in violation of these rules or any applicable laws relating to the raffle, or to be acting in an unsportsmanlike or disruptive manner. The Raffle Administrator will resolve all disputes at its sole discretion. Any attempt by any person to undermine the legitimate operation of the raffle may be a violation of criminal and civil law, and, should such an attempt be made, The Board of Visitors reserves the right to seek damages from any such person to the fullest extent permitted by law. Any failure by The Board of Visitors and/or the Raffle Administrator to enforce any provision in these rules shall not constitute a waiver of that provision.
